Terms of Service
Gift List Service Terms and Conditions:
– The Gift List Service is for customers engaging Inspired Surprises to provide relevant gift suggestions of products and services based on their needs. This is a customised gifting service based upon the customers’ information.
– The customer is responsible for the provision of correct and accurate information in the completion of the Inspired Surprises survey and payment for the service.
– Inspired Surprises relies on the customers’ information provided in the completed survey to create the curated gift list of products and services. Whilst every effort is made to ensure the gift list meets the customers’ criteria and expectations, Inspired Surprises makes no warranties or representations as to the suitability of the products and services on the gift list for the gift recipient.
– Inspired Surprises will use its best efforts to ensure that the product and service details, descriptions and pricing are accurate at time of curating the gift list. Inspired Surprises accepts no responsibility or liability if the product or service details, pricing, description or availability has changed or altered after the time the recommendation is made. The curated gift list will be accurate at the date and time of the delivery of the list in terms of product/service availability and pricing.
– After the curated gift list is delivered, it is the customers’ responsibility to ensure that it selects the appropriate gift option on the list within 24 hours to minimise the risk of non-availability of product or service or pricing variations. The customer acknowledges and agrees that Inspired Surprises has no control over stock availability, the performance of services or pricing increase or decrease.
– Inspired Surprises aims to recommend quality products and services but is not liable if the product is faulty or there is a failure to deliver services from factors including but not limited to design or manufacturing flaws and cessation of business of third party suppliers.
– All repair, replacement or warranty claims will need to be brought to the manufacturer or supplier. Whilst Inspired Surprises will assist in this warranty process, it accepts no responsibility or liability for any repair, replacement or warranty claims which may arise.
– Inspired Surprises is not responsible or liable for postage, delivery and handling of the gifts. Unless the customer selects the Concierge option, the customer is required to make its own arrangements in relation to postage, delivery and handling of the gifts. Inspired Surprises is not responsible or liable for any delays in postage and delivery.
– To the maximum extent permitted by law including the provisions set out in the Competition and Consumer Act 2010, Inspired Surprises’ total liability to the customer arising out of or in connection with the provision of the services for which it is engaged, whether under the law of tort, in equity, under statute or otherwise, shall be limited to the aggregate cost of rectifying the services provided pursuant to the engagement.
– Inspired Surprises is not responsible or liable for any injury, death or illness suffered by the customer or third party in the use or misuse of the products or services.
– Inspired Surprises shall not be liable to the customer for any indirect or consequential loss or damage in connection with the services it provides.
– The engagement and services provided by Inspired Surprises is governed by the laws of Western Australia.
Concierge Service Terms and Conditions:
– The terms and conditions relating to the Gift List service are applicable to the Concierge Service in addition to the terms and conditions listed below.
– Inspired Surprises will commence the Concierge Service no later than 1 business day after the customer has selected and fully paid for the product or service together with any applicable postage, handling and delivery costs.
– The customer acknowledges and agrees to pay any additional postage, handling and delivery cost in addition to any previous payment made should there be additional cost incurred.
– The items selected for which the Concierge Service is to be applied cannot be changed unless written notification to Inspired Surprises is made within 24 hours of the placement and payment of the order is made and Inspired Surprises provides its express agreement of the acceptance of such change.
– The customer acknowledges and agrees that any allowed change in the order may incur additional charges and time delay for which Inspired Surprises takes no responsibility or liability.
– Inspired Surprises uses its best efforts to arrange a safe and efficient delivery service however is not responsible or liable for delays and/or damage that may occur through the actions or omissions of third parties in the postage, handling and delivery process.
-Inspired Surprises uses its best efforts to recommend and detail product recommendations however is not responsible or liable if the resulting product actually differs or has changes since the time of recommendation.
